Round 2 List 1 Exclusions Granted: Section 301

The U.S.T.R. announced additional Section 301 exclusions granted for List 1. This new round of exclusions comes in addition to the previous announcement made in December 2018.

On March 22, 2019, the United States Trade Representative released an official announcement to the Federal Register with a second round of exclusions to List 1 of the Section 301 tariffs on goods from China. These exclusions will be retroactive to July 6, 2018, and remain in place until March 25, 2020. They are in addition to the Round 1 Exclusions granted back on December 28, 2018. Also, the additional exclusions granted in Round 3, Round 4, Round 5, and Round 6.

These Section 301 exclusions must be claimed using the new HTSUS subheading 9903.88.06. And are available for any product that fits the product description regardless of if the importer was the one to file the exclusion.

What is Included in the Section 301 Exclusions for List 1 Round 2?

The list of exclusions for List one includes three existing 10-digit HTSUS subheadings and 30 specified product descriptions.

The following are the HTSUS specified in the announcement:

• 8412.21.0045
• 8430.31.0040
• 8607.21.1000

The other 30 specified product descriptions include items such as; submersible pumps; breast pumps; impellers and impeller housings; salad spinners; water filters for pools, aquariums, etc.; water purifiers; steel bucket elevators; rubber tracks used on construction equipment; automated data processing storage units; self-propelled pavers; check valves; electric motors; electrical transformers; soldering irons; liquid crystal display modules; and musical tuners.
